Waste Collection Barnet Service Terms and Conditions
These Terms and Conditions govern the provision of waste collection and related services by Waste Collection Barnet to residential and commercial customers. By making a booking, confirming a quote, or allowing our operatives to collect waste from your premises, you agree to be bound by these Terms and Conditions.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
1.1 Customer means any individual, business, organisation, landlord, agent or other party that requests or receives waste collection services from Waste Collection Barnet.
1.2 Services means any waste removal, rubbish clearance, recycling, bulky waste collection, garden waste removal, or similar waste-related service provided by Waste Collection Barnet.
1.3 Waste means any materials presented for collection by the Customer that fall within the categories accepted by Waste Collection Barnet in accordance with applicable waste regulations.
1.4 Contract means the agreement between the Customer and Waste Collection Barnet for the supply of Services, incorporating these Terms and Conditions and any written quotation or service confirmation issued by us.
2. Scope of Services
2.1 Waste Collection Barnet provides scheduled and one-off waste collection services within its operational area. The exact nature of the Services, including the type and volume of Waste to be collected and the collection date, will be agreed with the Customer at the time of booking.
2.2 We reserve the right to refuse to collect any items which are prohibited by law, hazardous, unsafe to handle, or not consistent with the description given at the time of booking.
2.3 Our Services relate to the collection, transfer and lawful disposal or recycling of Waste. We do not provide cleaning, disassembly, building, plumbing, electrical, or other ancillary services unless expressly agreed in writing.
3. Booking Process
3.1 Bookings may be made by telephone, email or through our online booking system, where available. A booking is an offer by the Customer to purchase Services in accordance with these Terms and Conditions.
3.2 A Contract is formed only when we confirm acceptance of the booking, either by issuing a written confirmation, providing a reference number, or arriving on site to commence the Services.
3.3 At the time of booking, the Customer must provide accurate information regarding:
a) The type of premises and access arrangements.
b) The approximate volume, type and nature of the Waste.
c) Any heavy, bulky or unusual items.
d) Any potential hazards, including but not limited to sharps, chemicals, electrical equipment, or asbestos.
3.4 Quotations are provided based on the information supplied by the Customer. If, upon arrival, the volume or type of Waste differs significantly from the information provided, we may adjust the price, amend the Service, or decline to complete all or part of the collection.
4. Access and Customer Obligations
4.1 The Customer is responsible for providing safe and reasonable access to the Waste at the agreed collection time, including any required parking or loading permissions.
4.2 Where collections are from private property, the Customer warrants that they have the authority of the property owner or occupier to allow access and to remove the Waste.
4.3 Where collections are from public or communal areas, the Customer is responsible for ensuring any necessary permits or authorisations are in place. We accept no liability for delays or failures to collect arising from the absence of required permissions.
4.4 The Customer must ensure that the Waste is clearly identifiable and separated from items not intended for removal. We are not liable for the removal of items that were not clearly identified as being excluded from the collection.
5. Waste Types and Regulations
5.1 Waste Collection Barnet operates in accordance with applicable UK waste management legislation and regulations. All Waste is transported and disposed of through appropriately licensed facilities.
5.2 We do not accept certain hazardous or regulated waste streams, including but not limited to:
a) Asbestos or asbestos-containing materials.
b) Clinical or medical waste, including sharps and contaminated materials.
c) Certain chemicals, solvents, oils, fuels or hazardous liquids.
d) Pressurised gas cylinders and some types of batteries.
e) Radioactive materials or any waste classified as dangerous goods.
5.3 Electrical and electronic equipment may only be collected where agreed in advance, and may be subject to additional charges to ensure compliance with relevant regulations.
5.4 The Customer is responsible for declaring any hazardous, restricted or special Waste prior to the collection. If we discover such items during the Service, we may refuse to collect them, adjust the price, or terminate the Contract without liability.
6. Pricing and Payments
6.1 Prices for our Services are based on factors including, but not limited to, the estimated or actual volume of Waste, its nature, weight, ease of access, and the time required to complete the collection.
6.2 Unless otherwise stated, all prices are quoted in pounds sterling and are exclusive of any applicable taxes that may be charged in addition.
6.3 We may require full or partial payment in advance at the time of booking. Where payment is not taken in advance, payment is due immediately upon completion of the Service.
6.4 We accept the payment methods specified at the time of booking, which may include card payments, bank transfer, or cash. We reserve the right to refuse certain payment methods at our discretion.
6.5 If the actual amount of Waste collected is greater than that initially estimated or quoted, or if additional work is required to complete the collection safely and lawfully, we may increase the price accordingly. Any such adjustment will be explained to the Customer before proceeding where reasonably possible.
6.6 If payment is not made when due, we reserve the right to charge interest on late payments and to recover any reasonable costs incurred in the collection of overdue sums.
7. Cancellations, Rescheduling and Waiting Time
7.1 The Customer may cancel or reschedule a booking by contacting us using the details provided in the booking confirmation.
7.2 Where a cancellation is made more than 24 hours before the scheduled collection time, any pre-paid charges may be refunded or transferred, subject to any non-refundable administration fee notified at the time of booking.
7.3 Where a cancellation is made less than 24 hours before the scheduled collection time, we reserve the right to charge a cancellation fee up to the full value of the booking, to cover costs and loss of slot.
7.4 If our operatives attend the premises at the agreed time and are unable to gain access, or the Waste is not available for collection, this may be treated as a missed collection. In such cases, a call-out charge or full fee may be payable and no refund will be due.
7.5 Reasonable waiting time may be allowed at our discretion. Where waiting time exceeds our standard allowance due to issues under the Customer's control, additional charges may apply.
8. Service Delivery and Performance
8.1 We will use reasonable endeavours to perform the Services on the agreed date and within any estimated time window. However, all times are estimates only and may be subject to change due to traffic, weather, operational issues, or other circumstances beyond our control.
8.2 If we anticipate a significant delay or the need to reschedule, we will attempt to contact the Customer using the details provided at the time of booking. Our liability for any delay is limited as set out in these Terms and Conditions.
8.3 We reserve the right to subcontract all or part of the Services to suitably qualified and licensed contractors. In such cases, we will remain responsible for the proper performance of the Contract.
9. Damage and Liability
9.1 We will exercise reasonable care and skill in providing the Services. However, the Customer acknowledges that waste collection and bulky item removal may involve moving items through tight spaces, stairways, or external areas where minor scuffs, marks or incidental damage may occur.
9.2 The Customer should take reasonable steps to protect floors, walls, fixtures and fittings prior to the collection. We are not liable for wear and tear or minor cosmetic damage that could reasonably be expected in the course of normal waste removal.
9.3 Our total liability for any loss or damage arising out of or in connection with the Services, whether in contract, tort or otherwise, shall not exceed the total price paid or payable by the Customer for the specific Service giving rise to the claim.
9.4 We shall not be liable for any loss of profits, loss of business, loss of goodwill, loss of data, or any indirect or consequential loss or damage arising from or in relation to the Services.
9.5 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which liability cannot legally be excluded or limited.
10. Customer Indemnity
10.1 The Customer shall be responsible for any loss, damage, costs or expenses suffered by Waste Collection Barnet arising from:
a) The Customer's breach of these Terms and Conditions.
b) The provision of inaccurate or misleading information about the Waste or the collection location.
c) The presence of hazardous, illegal or improperly declared Waste.
10.2 The Customer agrees to indemnify Waste Collection Barnet against any claims made by third parties arising from the removal of Waste from premises where the Customer did not have proper authority to authorise the collection.
11. Complaints
11.1 If the Customer is dissatisfied with any aspect of the Services, they should notify us as soon as reasonably practicable, providing full details of the issue.
11.2 We will investigate any complaints in good faith and, where appropriate, may request reasonable evidence, such as photographs or documentation, to help assess the situation.
11.3 Where a complaint is upheld, we may, at our discretion, offer a remedy such as a partial refund, a re-visit, or an alternative resolution. Our decision will take into account the nature of the complaint, the evidence provided, and the extent of any proven loss.
12. Data Protection and Privacy
12.1 In the course of providing the Services, we may collect and process personal data relating to the Customer. Such data will be handled in accordance with applicable data protection legislation.
12.2 Personal data will be used for purposes such as managing bookings, delivering Services, processing payments, and handling enquiries or complaints. We may also retain data for legal, accounting or regulatory purposes.
13. Force Majeure
13.1 We shall not be liable for any failure or delay in performing our obligations under the Contract where such failure or delay is caused by events beyond our reasonable control. These events may include, without limitation, extreme weather conditions, natural disasters, acts of government or authorities, road closures, strikes, lockouts, equipment failure not caused by our negligence, or other similar events.
13.2 If a force majeure event continues for a prolonged period, we may terminate the Contract without liability, subject to refunding any pre-paid fees for Services not provided.
14. Variation and Termination
14.1 We may amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to that particular Contract.
14.2 We may terminate the Contract or suspend the provision of Services with immediate effect if the Customer commits a serious breach of these Terms and Conditions, fails to make payment when due, or behaves in an abusive or threatening manner towards our staff or contractors.
15. Governing Law and Jurisdiction
15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.
15.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided.
16. General Provisions
16.1 If any provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall remain in full force and effect.
16.2 No failure or delay by Waste Collection Barnet in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.
16.3 The Contract is between Waste Collection Barnet and the Customer. No third party shall have any rights to enforce any of its terms.
16.4 These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between the parties and supersede any prior understandings, arrangements or representations relating to the subject matter.
